Lackawanna County Files Opioid Lawsuit
Lackawanna County filed a lawsuit today in Pennsylvania State Court for money damages against 14 Pharmaceutical Companies. The suit maintains that the pharmaceutical companies were aware of the addictive nature of these medications but failed to warn the prescribers and others. Recently, CVS Caremark announced that they will limit the amount and strength of opioids for patients taking the drugs for the first time.
“We are grateful and honored to be selected by the Lackawanna County Commissioners for this case involving both a local and national crisis. We specifically want to thank Commissioner Pat O’Malley for his foresight and understanding of the magnitude of this national health epidemic,” said Senior Partner Joseph Cappelli. Cappelli also stated “CVS should be praised for taking an important first step in limiting availability of these addictive drugs to first time users”.
Marc Bern and Joseph Cappelli are leading the litigation on behalf of the New York law firm Marc J. Bern & Partners, LLP with additional offices in Pennsylvania, Delaware, New Jersey, Illinois and California. The law firm O’Malley & Langan of Scranton are co-counsel for the County in the litigation.
In addition to this litigation, Marc J. Bern & Partners and O’ Malley & Langan, have an ongoing working relationship in a groundbreaking products liability lawsuit in which they represent nearly 4,000 firefighters nationwide. This includes almost 500 firefighters throughout Pennsylvania, including Scranton. The defendant is Federal Signal Corporation, the manufacturer of sirens. The sirens are claimed to be defective due to their failure to direct dangerous and harmful noise away from the firefighters. An alternative product exists that can reduce the sound levels to the firefighters but still provide the same warning to motorists and pedestrians. Mr. Bern and Mr. Cappelli start trial in Pittsburgh on this issue the 27th of this month.
