“Still, I’m willing to look at other ideas to bring down costs, including one that Republicans suggested last year: medical malpractice reform to rein in frivolous lawsuits,” President Obama recently commented on tort reform in his State of the Union address. “Reform” means pushing injured victims out of the courthouse so that insurance companies can bank reserved settlement funds that would be used to compensate those injured, unable to work, and enjoy their lives because of medical malpractice.

Of course, insurance companies have attempted to convince everyone that insurance premiums for physicians and auto drivers have risen because of injury claims, says Marc J. Bern & Partners. However, the insurance companies NEVER tell anyone what they do with the billions of dollars of insurance premiums that do not get paid out to injured victims. The statistics regarding how many people never file a claim and continue to pay premiums that end up on the profit side of the statement are a well kept secret. If insurance companies are running at a deficit, how do they have the funds to support political candidates and lobbying efforts?

The purpose of paying premiums to insurance carriers is to pay out claims to those legally eligible. The idea was never for insurance companies to collect premiums and simply keep them, was it? What a great legal scam – create a law that an individual must have auto insurance so they have to pay premiums. Then, create laws through lobbying that prevent innocent victims from collecting on their claims. This way, you can simply keep all the money!

The fact of the matter is we live in a democratic society that determines justice in a courtroom, not in a boardroom of an insurance company or a lobbying enterprise. Insurance companies with a stake in the action should not have any part in provoking politicians to create laws against an injured victim. These companies are lobbying for a greater profit, and not for the rights of victims. Those who have false claims will be weeded out through our justice system. Those injured and out of work should be compensated by those who negligently caused their lives to change.
